Vacation Rental Terms & Conditions & Guest Code of Conduct
Royal Key Properties Ltd. (Agency)
We are pleased to make homes available for visitors to share and enjoy all that the Turks and Caicos Islands has to offer. Please bear in mind that the home you are renting is someone's personal residence and in a neighbourhood with many permanent residents. To ensure the quality of our homes and the peace and quiet of our neighbourhoods, all occupants must adhere to the guest code of conduct and our rental terms and conditions. Certain homes have additional restrictions so please contact or message us in advance of booking to make sure this home and our policies are compatible with your group and intended use. We thank you in advance for your understanding.
-Identification and Use: The names and ages of all occupants and proposed use of the property must be provided. A government-issued identification and the credit card used at the time of booking must be presented at check-in. All adult groups must be 25 years of age or older...not applicable to family groups.
-Maximum Occupancy: Guests shall not exceed the number of adults and the children publised on the property listing. Additional daytime guests are limited to a maximum of 4 and must depart prior to 10:00pm unless previously discussed with managment. House parties and/or gatherings are strictly prohibited and will result in immediate eviction with no refunds.
-Noise: Guests must keep the volume of voices and music to a reasonable level and respect quiet hours after 11:00pm.
-Trash: All garbage items should be bagged, tied closed, and placed only in the trash bin. Please contact us if bins are full.
-Parking: Do not exceed the designated amount of parking provided on the property. Do not block neighbouring driveways or use others' parking spots, and maintain access for emergency behicles at all times.
Please do not proceed with a booking if you are not comfortable with these policies.
- Responsible Party: "Guest" is an adult at least 25 years of age and will be occupying the home during the entire reserved period unless other arrangements are approved in writing by Management. The Guest and occupants' government issued I.D. must be presented upon request. The Guest assumes responsibility for the actions of all occupants and visitors to the property. No keys or entry code will be issued to anyone who is not an adult, at least 25 years of age. Any reservations found to be obtained under false pretence will be subject to forfeiture of all payments and deposits and the party will be required to vacate the property immediately.
- Cancellation: Should The Guest wish to cancel their reservation, the notice of cancellation must be in writing. The Guest is responsible to verify receipt and confirmation in writing from Royal Key Properties Ltd. For notice received 30 days or more prior to the check-in date, Royal Key Properties will authorize 100% of payments received, less banking fees, if applicable. For notice received after 30 days prior to check in date, Guests will be liable for 100% of the contracted amount, cleaning fees and taxes. There are no refunds given for early departures, delayed arrivals, construction activity in the neighbourhood, inclement weather, or reduction in the number of nights reserved for any reason. If the Home becomes unavailable or unsuitable for rent for any reason whatsoever, including but not limited to, casualty loss, construction, noise, physical deterioration, or loss of utility services, the Agency's liability will be limited to the return of all monies paid on account at the time of cancellation. In the event The Agency (Royal Key Properties Ltd.) cancels the reservation, the Agency will attempt to substitute the Home with a like-kind. The refund of all monies received will be initiated by the management company within seven (7) business days of confirmation of notice of cancellation.
- Termination: Royal Key Properties Ltd. or its agent has the right to inspect and photograph the condition of the premises without prior notice at any time to enforce the terms of this agreement and the laws of Turks & Caicos Islands, British West Indies. Should the guest or any occupants violate these terms, the guest shall waive all rights to due process and will vacate the premises. The guest is notified that all individuals occupying the property will be subject to immediate eviction procedures. The agency or its agent may enter the premises and remove the guest, the members of the Guest's party, and their belongings.
- Rents and Payment Terms: 50% of the total amount is due for reservations and is payable at the time of booking. The balance of the total amount for the reservation is due 30 days prior to arrival. Visa or Mastercard are the accepted forms of payment. The Guest agrees to provide the agency with a valid credit card to be used for ay damages. Should the Guest fail to make the final payment in full by the due date, the agency may, in its sole discretion, deem the reservation null and void or charge the final payment to the Guest's credit card. Should the guest utilize a different party's credit card for payment, it must be pre-approved by the agency. The Guest assumes all liability and will be financially liable for any disputed or chargeback amounts by said party. In the event incorrect information or rates are quoted due to a typographical or other error, the agency shall have the right to refuse, cancel or limit any reservations listed incorrectly.
- Security Deposit/Vacation Rental Demage Protection (VRDP): A security deposit of at least $500 is included on the invoice and will be refunded up to 48 hours after check out if there has not been negligent or deliberate damage. If damages exceed the retained deposit amount, the primary guest will be responsible for the payment of damages. We understand the instances of normal "wear & tear" as well as accidental damages and use discretion in such instances. Please inform Royal Key Properties Ltd. of any damages or loss so an agreement can be reached before guests leave the island Under the umbrella of damage in included broken glass in the pool. This will result in the deposit being withheld. If paddle boards, kayaks, bikes, etc are damaged, lost or stolen while you are using them, the primary guest will be responsible for the repair or replacement. Interiors and screened porches are completely non-smoking. If the odor of smoke is detected, the security deposit will be used for deep cleaning. If this interferes with the reservation(s) to follow, the guest may be responsible for loss of rental income.
- Reservation Transfers: Should the guest need to transfer the reservation to a substitute guest, substitute guest must be approved by the agency and agree to all current terms and conditions.
- Check-In: Check-in time is pre-arranged with the host assigned by the agency. Early check-in is allowed only with prior approval. Keys or entry code will be provided once all fees and charges have been collected.
- Check-Out: Check out time is 11:00am. Cleaning and maintenance are pre-schedule, adhering to the Check-Out time is very important.
- Check-Out/Cleaning Procedures: Each home will be inspected, sanitized and cleaned prior to your arrival and after your departure. Guests should leave the home in the same general condition as it was at Check-In meaning: a)rubbish and discards removed or placed in the garbage, b)cooling and other messes cleaned up and dishwasher started, c)all remote controls left in plain sight, d)turn off lights, air conditioners appliances, etc., e)marke sure all doors and windows are closed and locked. The cleaning fee is for a standard cleaning and disinfection only. If the home was left in a state that additional cleaning is required, fees will be charged to the Guest credit card on file.
- Occupancy: Guests understand and agree that the home shall be occupied by no more than the number of individuals (including children and infants) indicated on the website listing and Guest Registration Form. Visitors are limited to 4 persons and must vacate the premises by 10:00pm unless otherwise discussed with Management.
- Amenities: The home is fully furnished and includes ready-made beds, at least 1 set of bath towels per guest and an equipped kitchen. Furnishings and amentiies are not always new and may exhibit signs of wear and tear. Amenities and furnishings are subject to change and may or may not be the exact same as represented due to replacement, substitution or other reasons. The agency provides a starter kit of soaps, dish detergent, laundry soap, shampoo, toilet paper, paper towels and other dispensable items. Since a limited supply is provided, the guest should plan to shop to replensih these items, if necessary for their own use. Towels, (except beach towels) and linens are not to be taken from the properties.
- Telephones: Landline phones are not customarily provided. Emergency medical, fire and police services can be called by dialing 911.
- Disturbances: The Primary Guest and all other guests shall behave in a civilized manner and shall be good neighbours, respecting the rights of the surrounding neighbours and shall not create noise or disturbances that interfere with the enjoyment of their property. Outdoor noise or noise carrying outside from inside the home should be kept to a minimum regardless of the hour and in compliance with the local noise ordinance.
- Guests' Notification Responsibilities: We ask the Guest to examine the property, furniture, furnishings, appliances, fixtures and appearance of the property and to report any deficiencies upon discovery. The Guest also agrees to immediately notify the agency of any occurrences that may cause damage to the property or adjacent homes and to take any necessary measures to mitigate damage. The Guest acknowledges that, unless the agency is notified of any damage or cleaning concerns, the agency will not be held accountable. All damages, breakages, lost or missing items during the occupancy by the Guest will be the Guests' responsibility and must be reported to the agency prior to departure.
- Multiple Home Rentals: Should the Guest or acquaintance of the Guest rent another home in proximity to the property, no items shall be moved from home to home.
- Garbage: The Guest shall place all food scraps in the garbage. All waste generated during the rental period must be disposed of in trash bags and in the receptacles provided. The Guest is cautioned not to leave the trash outside as it can attract pests.
- Septic System: The Guest understands that the septic systems at Royal Key Properties Ltd.'s properties use a natural bacterial process to break down waste. The Guest therefore agrees NOT to flush hygiene, personal care products and wipes or any product other than bathroom tissue down the toilets as these block the pipes and destroy the natural processes, which in turn inconvenience other guests when these systems are not operating properly.
- Subleasing: The Guest shall not assisn, sublease, host parties/events at the property or permit the use of any portion of the property by other persons who are not family members or guests.
- Smoking: No smoking is allowed on the premises. If smoking does occur, guests may be evicted and are financially responsible for all damage caused by the smoking, including, but not limited to, stains, burns and the cost of odor remediation and removal and replacement of damaged property. These terms and conditions also include the loss of income if the results of the smoking violation interfere with future reservations.
- Animals: Animals are not permitted on the properties unless otherwise designated. If an unauthorized pet is found on the premises, guests may be evicted and the Guest is responsible to remedy any and all pet damages and the cost of remediation, including allergen remediation, flea remediation and reimbursement to the agency. This includes any refunds or costs necessary to relocate or compensate for the relocation of future guests until remediation is completed.
- Transient Occupancy: Guests expressly acknowledge and agree that this agreement is regarding transient occupancy of the home and that the Guest does not intend to make the home a residence or household.
- Owners' Property: The Guest agrees not to access the owner's storage area, even if unlocked, which contains the owner's personal property and may contain cleaning supplies and chemicals that could be hazardous to children and adults.
- Security: The Guest shall see to their own and to the home security by locking doors, windows, garage doors, etc. when it is prudent to do so and always when the home is unoccupied. For villas that are equipped with a security/alarm system, we recommend the Guest use the system provided.
- New Locks or Alterations: The Guest shall not make or permit to be made any alterations to the premises or to change or add any locks.
- Lost Items: The agency shall bear no responsibility for lost, stolen or abandoned items. Every reasonable effort will be made to contact the guest for return. There will be a minimum of $25.00 handling charge plus shipping costs for any found items returned at the guest's request. Royal Key Properties Ltd. shall not be held liable for the condition of said items. Any items not cleamed for longer than 30 days may be donated or sold.
- TV/Cable/internet/Satellite: Services are provided as a convenience only and are not integral to this agreement. No refund of rents shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences in regard to service.
- Air Conditioning: All rentals are equipped with air conditioning. Doors and windows are to be closed when air conditioning is in operation. There are no refunds for the malfunctioning of and AC unit with the understanding that the agency will make every effort to have all units in working order or to facilitate the repainr of the units should they fail while the Guest is in residence.
- Pools: The Guest understands that the area surrounding the pool may not be fenced or secure. The Guest also understands and agrees to be responsible le and liable and will pay the agency upon request for any damages that occur to the pool and related systems because of tampering, misure, and/or neglence. Liability includes the occurrence of broken glass in the pool which may result in temporary closure and inability of the Guest to use the pool for the remainder of the rental dates. All guests agree to use the plastic dishes provided for guest use in the area of the pool.
- In the event the home sustains a failure of a system, including but not limited to water, sewer, septic, electrical, gas, plumbing, mechanical, appliances, AC, ventilating, pool or other system or structural systems, furnishings or amenities, the agency will make every reasonable effort to repair or replace the failed system or equipment, and in such event, the guest agrees to permit agency or its service provider to have reasonable access to the property to inspect and make such repairs. Neither the homeowner nor the agency shall be liable to the guest for damages and no refunds will be given for such failures.
- Noise and noise transmission: The Guest is aware that the home is in a populated area and it is subject to noice from nearby residences/businesses/traffic and or construction. If the home has common walls, ceilings, or floors, noise may travel between and cause disturbance to the Guest from other residences.
- Other Occurrences: The agency does not accept liability for any loss or damage caused by but not limited to the following: weather, natural disasters, pests, construction disturbances, pandemics, acts of God, or other reasons beyond its control. There shall be no refunds of rents because of shortened stays, ruined, expectations, or departures due to work and family emergencies, illness, unavailability of any or all parts of the home, or any other reasons.
- Sale/Lease/ of Home: If the home is actively listed for sale or lease, the agency may notify the guest to schedule and show the property.
- Waiver of Liability: It is the Guest's responsibility to practice and explain safety precautions to other occupants of "Special Features" such as pools. The Guest understands that there are special risks involved for anyone, particularly children who are not carefully supervised, person(s) intoxicated, on any kind of drugs or medication, with health risks, or if pregnant. The guest agrees to explain the risks of the presence and use of Special Features to all occupants at the home. The Guest agrees to instruct all guests on premises to not access any off limit, or unsafe sections of the property including roof-tops. Swimming pools may not be fenced. The guest agrees to assume all responsibility to make all occupants aware of risks and for the consequences of those risks and to be fully and solely responsible for any accidents that may occur. The Guest agrees to waive any claim whatsoever against the homeowner or Royal Key Properties Ltd. for accidents or claims.
- Reservations Are Not Fully Guaranteed: If, for any reason, the property is not available or bcomes unavailable or uninhabitable for the reservations dates, every effort will be made to locate substitute accommodation. If the substituted home rents for more for the same period, or remaining period respectively, the Guest will have the options to pay any additional charges or cancel the reservation within 72 hours of notification of the Guest by the agency. If the home rents for more than the original accommodation, the agency will make every effort to secure it for the same rental rate as the previous property. If the substituted home rents for less for the same period, the difference will be refunded to the guest.
- Agency: It is mutually understood and agreed that Royal Key Properties is acting as the agent only for the homeowner and has no liability to either party for the performance of any terms or covenant of this agreement. Furthermore, the Guest understands the agency is being compensated in this transaction by the homeowner and is contractually obligated to protect the interest of the same.
- Hold Harmless:The Guest and all occupants shall hereby indemnify and hold harmless Royal Key Properties and the homeowner against any and all claims of personal injury, property damage, or loss arising from the use of the premises regardless of the nature of the accident, injury or loss. The Guest also expressly recognizes that any insurance for property damage or loss, which the Landlord may maintain on the property, does not cover the personal property of the Guest and that the Guest should purchase their own insurance if such coverage is desired.
- Additional Terms & Conditions: The Guest, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Royal Key Properties and the owner from any and all claims, demands, and causes of action by reason of any injury or whatever nature which may have occurred to the guests or any of his/her occupants or guests as a result of, or in connection with the occupancy of the premises and agrees to hold the agency and the owner free and harmless of any claim or suit arising therefrom. In any action concerning the rights, duties, or liabilities of the parties to this agreement, their principals, agents, successors, or assignees, the prevailing party shall be entitled to recover reasonable attorney fees and costs.
- Disputes: Any disputes under this agreement shall be governed by and interpreted in accordance with the laws of the Turks and Caicos Islands. Any action relating to the agreement shall be filed only in the court system of Turks and Caicos in which is home is located. Both parties' consent to the exclusive venue and jurisdiction of such court. The Guest agrees to pay all reasonable costs, attorney's fees and expenses that shall be made or incurred by Royal Key Properties enforcing this agreement.
- Credit Card Authorizations: The Guest agrees to provide Royal Key Properties with a valid credit card for the duration of the reservation. The Guest is providing the credit card as a guarantee. The Guest certifies that he/she has read and agrees to abide by the terms of the agreement and agrees to pay and authorize the agency to charge any rental amounts, taxes, security deposits, extra cleaning, missing property and any damages not covered under the Security Deposit Protection And fines or charges pertaining to violations of the rental agreement. The Guest understand that all credit card sales are final. Should the agency be unable to recover costs from the credit card on file, the Guest is responsible to provide an alternative method of reimbursement within 48 hours of notification.
- Electronic Consent: By checking the box and clicing on the "I Agree" button, the Guest is consenting to the use of an electronic signature in lieu of an original signature on paper. The Guest should always ensure that the Agency has a current email address on file to contact the Guest regarding any changes, if necessary.
Effective: October 21, 2022
